FASCIA TRAINING INSTITUTE
TERMS AND CONDITIONS
Please read these Terms and Conditions (the “Terms”) carefully before purchasing, accessing, enrolling in, registering for, attending, or participating in any product, supplement, course, workshop, certification pathway, event, treatment demonstration, digital resource, membership, or other offering made available under the Fascia Training Institute brand.
By completing a purchase, checking an acceptance box, signing an enrollment document, accessing course materials, attending an offering, or otherwise participating, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, do not purchase, access, attend, or participate in an FTI Offering.
1. Contracting Parties and Definitions
1.1 Contracting entity
“FTI,” “we,” “us,” and “our” mean Fascia Training Institute and the legal entity identified as the seller or service provider on your checkout page, invoice, receipt, enrollment agreement, or order confirmation. Depending on the location and nature of the transaction, that entity may be:
Simone Fortier Enterprises Inc., for transactions contracted through the Canadian business; or
Fascia Brain Treatment & Training Inc., for transactions contracted through the United States business.
Each entity may operate under or use the Fascia Training Institute brand. The entity identified on the applicable transaction document is the party responsible for that transaction.
1.2 Participant
“Participant,” “you,” and “your” mean the purchaser, registrant, attendee, student, practitioner, demonstrator, subscriber, account holder, or other person accessing or participating in an FTI Offering. If an organization purchases an FTI Offering for an individual, both the organization and the individual are responsible for complying with the provisions applicable to them.
1.3 FTI Offerings
“FTI Offerings” include, without limitation:
Educational courses, certification pathways, workshops, seminars, practicums, and live or virtual events;
Treatment demonstrations, supervised practice sessions, and approved demonstrator sessions;
Digital courses, recordings, manuals, downloads, online communities, and private forums;
Products, dietary supplements, equipment, and other physical goods; and
Any related communication, bonus, resource, platform access, or participant benefit supplied by FTI.
1.4 Order-Specific Terms
An enrollment agreement, payment plan agreement, event waiver, product description, checkout disclosure, certification standard, practitioner agreement, or other written term issued for a particular FTI Offering is an “Order-Specific Term.” These Terms and all applicable Order-Specific Terms form the complete agreement for that transaction. If they conflict, the more specific Order-Specific Term controls only with respect to that subject matter.
2. Eligibility and Authority to Agree
You must be at least the age of majority in your jurisdiction and legally capable of entering into a binding agreement. If you purchase on behalf of a business or organization, you represent that you have authority to bind that entity.
FTI may establish prerequisites, professional credentials, licensing requirements, health screening, age restrictions, or other eligibility criteria for a particular offering. You are responsible for providing complete and accurate information. FTI may deny or revoke enrollment if eligibility information is false, incomplete, misleading, or cannot be verified.
3. Enrollment, Orders, and Availability
An order is accepted only when FTI issues an order confirmation or otherwise confirms enrollment. FTI may decline or cancel an order before acceptance, including because of pricing errors, insufficient capacity, suspected fraud, eligibility concerns, product unavailability, or regulatory restrictions.
Course descriptions, schedules, instructors, locations, formats, product images, and availability may change. Minor changes that do not materially alter the purchased offering do not create a right to a refund.
Access, seats, bonuses, transfers, examination eligibility, and certification are personal to the registered Participant unless FTI approves otherwise in writing.
4. Prices, Taxes, Currency, and Payment Authorization
Prices are stated in the currency displayed at checkout and exclude applicable taxes, shipping, customs charges, duties, foreign-exchange costs, and payment-processing charges unless expressly stated otherwise.
You authorize FTI and its payment service providers to charge the payment method you supply for all amounts due under the selected payment option. You represent that you are authorized to use that payment method and that the billing information provided is accurate.
Any credit-card or processing fee will be disclosed before payment and charged only where permitted by law. You are responsible for charges imposed independently by your bank, card issuer, or currency-conversion provider.
5. Payment Plans, Defaults, and Charge Disputes
5.1 Payment-plan commitment
A payment plan is a commitment to pay the full purchase price in installments; it is not a month-to-month subscription and is not cancellable merely because a Participant stops attending, accessing, or using the FTI Offering.
Unless Order-Specific Terms state otherwise:
The first installment is a non-refundable enrollment deposit, except where applicable law requires otherwise;
Scheduled installments will be charged automatically on the agreed dates;
The Participant must keep a valid payment method on file and promptly update payment information; and
A late administration fee of $20 plus applicable taxes per month may be charged on overdue amounts, to the extent permitted by law.
5.2 Default
Failure to pay a scheduled installment, an unjustified payment reversal, or refusal to complete an agreed payment plan constitutes a material breach. Subject to applicable law and any Order-Specific Terms, FTI may:
Suspend course, platform, examination, certification, and practitioner-designation access;
Cancel reserved attendance or transfer privileges;
Declare the unpaid balance immediately due;
Recover reasonable collection costs, court costs, and legal fees where legally recoverable; and
Exercise any other lawful remedy.
Suspension or removal for non-payment does not, by itself, cancel the outstanding balance.
5.3 Billing concerns and chargebacks
Participants should contact info@fasciatraininginstitute.com promptly to address a billing concern. A chargeback or payment reversal does not automatically terminate the underlying payment obligation. Nothing in these Terms limits a Participant’s non-waivable rights under card-network rules or applicable consumer law.
6. Refunds, Cancellations, Credits, and Transfers
All policies in this section apply except to the extent a refund, cancellation, replacement, or other remedy is required by applicable law.
6.1 Products and supplements
Because of health, safety, quality-control, and inventory considerations, products and supplements are final sale once shipped or collected. FTI does not accept returns or exchanges for change of mind, personal preference, taste, failure to use the product, or dissatisfaction with individual results.
This final-sale policy does not eliminate any remedy required for a product that is damaged in transit, defective, incorrectly supplied, recalled, or otherwise subject to a mandatory legal remedy. Claims should be submitted promptly with the order number and supporting photographs where relevant.
If an item is backordered, FTI may provide an estimated fulfillment date, offer an available substitute with your consent, maintain the order, or cancel and refund the unavailable item when required or appropriate. Shipping estimates are not guarantees.
6.2 Courses, workshops, certification pathways, and events
Enrollment fees, deposits, and amounts paid are non-refundable unless Order-Specific Terms or applicable law expressly provide otherwise. Failure to attend, complete prerequisites, participate, access materials, or achieve a desired result does not create a right to a refund.
A Participant who cannot attend may request an approved transfer or credit under Sections 6.3 and 6.4. A no-show without prior written approval results in forfeiture of the amount paid and any reserved seat.
6.3 Participant transfers to another date
For a pay-in-full registration:
A request received at least 30 days before the scheduled start date may be transferred once to an eligible FTI date, subject to capacity and any price difference;
A request received fewer than 30 days before the start date is subject to a $100 plus applicable taxes rebooking fee, in addition to any price difference; and
A transfer is effective only after FTI confirms it in writing.
Unless FTI approves otherwise in writing, the transferred offering must be attended within 12 months after the original purchase date. If FTI does not make a reasonably comparable date available during that period, FTI may extend the credit or provide another remedy consistent with applicable law.
6.4 Transfer to another person
An eligible event registration may be transferred to another qualified person with FTI’s prior written approval and payment of a $100 plus applicable taxes transfer fee. The replacement Participant must satisfy all prerequisites, sign all required documents, and accept the then-current Terms. Course progress, examinations, certifications, digital access, and practitioner status are not transferable.
Requests must be submitted to info@fasciatraininginstitute.com.
6.5 Credits and amounts held
Any credit or amount FTI agrees in writing to hold for future use expires 12 months after the original purchase date unless the written approval states otherwise. An unused credit has no cash value, may not be combined with another promotion, and is not transferable unless FTI expressly approves the transfer. Expiry and forfeiture remain subject to applicable law.
6.6 Changes or cancellation by FTI
FTI may reasonably change an instructor, trainer, venue, date, schedule, curriculum, delivery format, class size, or other operational detail. If FTI cancels an offering and does not provide a reasonably comparable replacement, FTI will provide a credit, transfer, or refund as required by the applicable Order-Specific Terms and law.
FTI is not responsible for a Participant’s travel, accommodation, meals, lost income, exchange-rate loss, or other consequential expense arising from a schedule or location change. Participants are encouraged to purchase refundable travel and appropriate travel insurance.
6.7 Events beyond reasonable control
FTI is not in breach for delay, relocation, modification, or inability to perform caused by events beyond its reasonable control, including severe weather, natural disaster, epidemic, public-health restriction, travel disruption, labor interruption, venue failure, utility or internet outage, government action, civil disturbance, or instructor illness. FTI will use commercially reasonable efforts to reschedule, relocate, provide remote access, issue a credit, or provide another appropriate remedy.
7. Educational Purpose; No Guarantee of Results
FTI Offerings are educational and informational. Individual results vary. FTI does not guarantee:
Health, symptom, treatment, rehabilitation, or performance outcomes;
Course completion, examination results, certification, licensing, employment, referrals, income, business growth, or professional success; or
That any technique, product, protocol, or information will be appropriate for every person, client, patient, condition, or jurisdiction.
Testimonials, demonstrations, case examples, research discussions, and success stories illustrate individual experiences or educational concepts. They are not promises, warranties, or representations that another person will achieve the same or similar result.
8. Medical, Health, Legal, Financial, and Regulatory Disclaimer
FTI does not provide individualized medical, legal, financial, tax, insurance, or regulatory advice through its educational offerings. Educational content is not a substitute for diagnosis, treatment, advice, or supervision from an appropriately licensed professional who understands the relevant circumstances.
Products and dietary supplements are not represented as a substitute for medical care. Participants should consult an appropriately qualified healthcare professional before beginning a supplement or physical practice, particularly when pregnant or nursing, taking medication, managing a medical condition, preparing for surgery, or experiencing an adverse reaction.
In the United States, statements concerning dietary supplements have not been evaluated by the Food and Drug Administration unless expressly stated otherwise. Dietary supplements are not intended to diagnose, treat, cure, or prevent disease.
9. Professional Responsibility and Scope of Practice
FTI education does not expand a Participant’s legal scope of practice, create a healthcare license, authorize diagnosis or treatment, or replace professional supervision required by law.
Before applying any information or protocol, a Participant is solely responsible for:
Maintaining all required licenses, registrations, insurance, qualifications, and continuing education;
Determining whether the activity is lawful and appropriate within the Participant’s jurisdiction and professional scope;
Obtaining informed consent and conducting appropriate screening, referral, documentation, infection-control, and safety procedures;
Exercising independent professional judgment rather than relying solely on FTI content; and
Stopping, modifying, or referring when a client’s or patient’s presentation requires care beyond the Participant’s competence or authority.
FTI may require proof of current credentials or insurance at any time.
10. Course Completion, Certification, and Practitioner Status
Attendance, course completion, certification, authorization to use a designation, permission to provide a protocol, and authorization to teach are separate rights.
Unless FTI expressly confirms otherwise in writing:
Enrollment or attendance does not guarantee course completion or certification;
Completion of one level does not authorize use of a higher-level protocol or designation;
Certification may require attendance, prerequisite coursework, written and practical assessments, case studies, payment in full, professional eligibility, and compliance with current standards;
Practitioner status may require renewal, recertification, continuing education, current insurance, good standing, and ongoing compliance; and
No course, certificate, practitioner designation, or clinical-use authorization grants permission to teach, train, supervise, certify, license, or qualify another person in FTI Protected Content.
FTI may suspend, condition, decline, or revoke certification or designation rights for non-payment, false credentials, unsafe practice, material breach, misuse of intellectual property or trademarks, misrepresentation, or conduct that threatens public safety or the integrity of FTI’s programs. FTI will act reasonably and in accordance with any applicable certification policy.
11. Assumption of Risk and Participant Safety
Physical demonstrations, manual techniques, movement practices, treatment simulations, supplement use, and supervised practice may involve known and unknown risks, including discomfort, aggravation of symptoms, allergic reaction, physical injury, emotional response, or other adverse outcomes.
By voluntarily participating, you acknowledge that:
You are responsible for assessing your ability to participate and for disclosing relevant limitations to the appropriate instructor or licensed professional;
You may decline or stop an activity at any time;
You will follow safety instructions and will not perform an activity beyond your competence, authorization, or comfort; and
You voluntarily assume the ordinary and inherent risks of participation to the fullest extent permitted by law.
Where required, you must sign a separate informed-consent, event-waiver, or liability-release document. These Terms do not replace a more specific waiver. Nothing in these Terms releases liability that cannot lawfully be released, including liability for fraud, willful misconduct, gross negligence where non-waivable, or any other non-excludable duty.
12. Participant Conduct, Safety, and Removal
Participants must act professionally, respectfully, lawfully, and safely. Prohibited conduct includes harassment, discrimination, threats, abuse, disruption, intoxication, unsafe practice, unauthorized recording, academic dishonesty, credential misrepresentation, infringement, solicitation contrary to event rules, or interference with another person’s learning, privacy, or safety.
FTI may issue directions, restrict participation, suspend access, or remove a Participant when FTI reasonably believes the action is necessary to protect safety, learning, operations, intellectual property, reputation, or legal compliance.
When removal results from a material breach, unsafe conduct, infringement, harassment, fraud, or non-payment, the Participant is not entitled to a refund, transfer, certification, or continued access, except where applicable law requires otherwise. Proportionate action may be taken when circumstances reasonably permit.
13. Demonstrators, Models, Guests, and Observers
A demonstrator, model, guest, or observer may attend only during a period and for a purpose expressly approved by FTI. Such persons may not enter restricted classrooms, access participant materials, record instruction, or participate beyond the permission granted.
Every demonstrator or model must complete the required informed-consent and liability documentation before participating. A Participant may not bring a guest, client, patient, or model without prior written approval.
14. Digital Access, Accounts, and Acceptable Use
Digital access is a limited, personal, revocable, non-exclusive, non-transferable license for the registered Participant’s own education and expressly authorized professional application.
Participants must not:
Share logins, access links, files, downloads, recordings, or private-forum content;
Permit another person to view or use paid content through the Participant’s account;
Circumvent access controls, download restrictions, watermarks, or security measures;
Scrape, index, data-mine, train an artificial-intelligence system on, or create a database from FTI content; or
Upload confidential client, patient, or participant information without lawful authority and appropriate safeguards.
Participants are responsible for activity through their accounts and must notify FTI promptly of suspected unauthorized access.
15. Intellectual Property, Confidentiality, and Prohibition on Teaching
15.1 FTI Protected Content
“FTI Protected Content” means all content and materials developed, owned, licensed, or supplied by FTI, including proprietary protocols, treatment sequences, assessment processes, systems, frameworks, course organization, manuals, presentations, recordings, demonstrations, illustrations, graphics, worksheets, case materials, examinations, terminology, confidential know-how, and instructional expression.
FTI Protected Content includes materials associated with Dynamic Brain Healing®, FTI’s upper-body and lower-body fascia protocols, and other FTI courses and systems identified in the applicable program materials.
Copyright protects FTI’s original manuals, videos, images, written explanations, presentations, and other original expression. FTI’s proprietary methods, protocols, sequences, know-how, and training systems are additionally protected, as applicable, through contract, confidentiality, trademark, trade-secret, unfair-competition, and other laws. Nothing in these Terms claims ownership of a Participant’s independently developed, pre-existing knowledge that does not use or derive from FTI Protected Content.
15.2 Ownership and reservation of rights
FTI Protected Content remains the exclusive property of FTI or its applicable licensors. Purchasing, attending, completing, or becoming certified in an FTI Offering does not transfer ownership and does not grant any right except the limited rights expressly provided in writing.
All rights not expressly granted are reserved. No implied license arises from enrollment, payment, attendance, certification, access, silence, prior practice, or failure to enforce a restriction on another occasion.
15.3 Limited authorization to apply designated protocols
Only where FTI expressly authorizes clinical or professional application may an eligible Participant apply a designated protocol:
Personally and non-transferably;
Within the Participant’s lawful scope of practice and demonstrated level of training;
In accordance with FTI’s current safety, certification, attribution, and professional-use requirements; and
Without teaching another person to perform or deliver the protocol.
Incidental explanation reasonably necessary to obtain informed consent or explain a service to a client or patient does not authorize skills instruction, protocol training, staff training, or transfer of FTI Protected Content.
15.4 Absolute prohibition on unauthorized teaching and training
Unless FTI provides prior, express written authorization signed by an authorized FTI representative, a Participant must not, directly or indirectly:
Teach, train, demonstrate for instructional purposes, supervise, mentor, assess, certify, license, qualify, or otherwise enable another person to perform, deliver, reproduce, or teach any FTI protocol, system, technique, assessment, treatment sequence, framework, or substantial component thereof;
Incorporate FTI Protected Content into any course, workshop, certification, mentorship, coaching program, membership, webinar, presentation, clinical or staff training, online program, social-media instruction, publication, manual, video, artificial-intelligence output, or other educational offering, whether paid or unpaid;
Copy, record, photograph, reproduce, upload, publish, share, distribute, sell, license, translate, adapt, summarize, transmit, or create derivative training materials from FTI Protected Content;
Rename, rebrand, rearrange, modify, combine, obscure the source of, or present FTI Protected Content as the Participant’s or another person’s method, protocol, system, discovery, or intellectual property;
Teach or commercialize a substantially similar version of FTI Protected Content under another name, sequence, format, brand, or description in an attempt to avoid these restrictions;
Train employees, contractors, colleagues, students, clients, patients, or any other person to perform an FTI protocol or protected component;
Issue or assist with any certificate, continuing-education credit, practitioner designation, license, or credential associated with FTI Protected Content; or
Authorize, encourage, facilitate, or assist another person or organization to do anything prohibited by this section.
These restrictions apply to live, recorded, written, verbal, visual, digital, virtual, and social-media instruction worldwide, regardless of whether compensation is received.
15.5 No recording or reproduction
Audio recording, video recording, photography of instructional content, screen recording, transcription, copying, or reproduction is prohibited unless FTI expressly authorizes it in writing. Permission to photograph a personal practice moment or public event area does not authorize recording or reproducing instruction.
15.6 Confidentiality
Non-public FTI Protected Content, examinations, instructor guidance, internal discussions, business information, and any other information identified as confidential or reasonably understood to be confidential must be protected from unauthorized access, use, and disclosure.
Confidentiality obligations do not apply to information the Participant can document: (a) was lawfully known without confidentiality restriction before disclosure by FTI; (b) becomes public without breach; (c) was independently developed without use of FTI confidential information; or (d) was lawfully received from a third party without a duty of confidentiality. If disclosure is legally compelled, the Participant must, where lawful, give FTI prompt notice and disclose only what is legally required.
15.7 Trademarks, program names, and public representations
FTI’s names, logos, marks, program names, course names, certification designations, taglines, and branding, including Dynamic Brain Healing® (collectively, the “FTI Marks”), may be used only as FTI expressly authorizes in writing.
Course completion does not authorize a Participant to:
Use an FTI Mark in a business name, trade name, domain, social-media handle, product, service, course, workshop, membership, or certification name;
Describe themselves as an FTI instructor, trainer, faculty member, representative, partner, licensee, or authorized training provider;
State or imply that FTI sponsors, endorses, approves, regulates, or is responsible for the Participant’s independent business or services; or
Alter, abbreviate, translate, combine, or remove the ® or ™ symbol from an FTI Mark contrary to FTI’s written brand standards.
Any trademark permission is limited, revocable, non-exclusive, non-transferable, and subject to FTI’s then-current written standards. FTI may require correction or removal of non-compliant use.
15.8 Practitioner designation and required clarification
Only a practitioner whose certification is current and in good standing may use the exact designation FTI has granted. When requested by FTI or when needed to prevent confusion, an authorized practitioner must use substantially the following clarification:
“[Name] is an FTI-authorized Dynamic Brain Healing® Practitioner. [Name] is not the creator or owner of the Dynamic Brain Healing® system, is not an FTI instructor, and is not authorized to teach or certify others in the system.”
Any attribution concerning ownership or registration of an FTI Mark must use the exact wording supplied by FTI. A Participant must not describe a protocol itself as “copyrighted”; copyright applies to FTI’s original instructional expression and materials, while other legal protections may apply to the protocol, system, confidential know-how, and brand.
15.9 Fair dealing, fair use, and legally protected activity
Nothing in these Terms eliminates a non-waivable right that applies under law. However, enrollment does not create a general “educational use” exception permitting a Participant to reproduce, distribute, commercialize, or teach FTI Protected Content. Any reliance on fair use, fair dealing, or another statutory exception is determined by applicable law and does not grant trademark, certification, affiliation, or confidentiality rights.
15.10 Enforcement and survival
Unauthorized teaching, disclosure, reproduction, certification, or trademark use may cause harm that cannot be adequately repaired by money alone. To the extent permitted by law, FTI may seek an injunction, takedown, corrective attribution, recovery of damages or profits, termination of access or status, and any other available remedy.
Sections 14 and 15 survive completion, withdrawal, suspension, expiration, or termination of the Participant’s relationship with FTI.
16. Media, Recording, and Participant Likeness
FTI may photograph or record portions of events for education, documentation, security, or marketing only in accordance with the notice and consent provided for the applicable event. Where identifiable likeness, voice, testimonial, or personal story will be used for promotional purposes, FTI may require a separate media release.
Attendance documents, liability waivers, informed consent, and promotional media consent are separate permissions. A Participant must complete documents reasonably required for safety, lawful participation, or approved recording. FTI will address any legally required accommodation or consent choice in accordance with applicable law and the Order-Specific Terms.
Participants may not photograph, record, post, or disclose another participant, client, patient, demonstrator, or instructor without all required permissions.
17. Testimonials, Research, and Case Examples
Testimonials and case examples must be truthful, authorized, and presented without distorting the person’s experience, research result, or scope of the evidence. They do not establish typical results or guarantee outcomes.
A Participant may not use FTI research, data, images, testimonials, case materials, or outcome claims in marketing without prior written permission and all legally required substantiation, context, disclosures, and consents.
18. Third-Party Products, Services, Links, and Platforms
Reference to a third-party product, professional, service, website, platform, research paper, or resource does not necessarily constitute endorsement, warranty, partnership, or adoption by FTI.
Third-party services are governed by their own terms and privacy practices. FTI is not responsible for third-party availability, security, content, acts, omissions, pricing, or policy changes except to the extent responsibility cannot legally be excluded.
19. Privacy and Communications
FTI may collect, use, store, and disclose personal information as described in its applicable privacy notice and as reasonably necessary to process transactions, administer programs, verify credentials, maintain safety, provide support, protect rights, comply with law, and communicate service information.
You consent to receive transactional communications related to purchases, schedules, safety, certification, account access, and policy administration. Marketing communications are subject to applicable consent and unsubscribe requirements.
Participants must protect personal and health information encountered during training and comply with all privacy, confidentiality, documentation, and data-protection duties applicable to their profession and jurisdiction.
20. Disclaimer of Warranties
To the fullest extent permitted by law, FTI Offerings are supplied on an “as available” basis. FTI disclaims implied warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, continuous availability, and compatibility.
Nothing in these Terms excludes an express written warranty or a statutory warranty, condition, guarantee, or consumer right that cannot legally be excluded or modified.
21. Limitation of Liability
To the fullest extent permitted by law, FTI and its owners, directors, officers, employees, instructors, contractors, hosts, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including lost income, lost opportunity, business interruption, reputational harm, travel costs, or loss of data, arising from or related to an FTI Offering.
To the fullest extent permitted by law, the aggregate liability arising from a particular FTI Offering will not exceed the amount the claimant paid to FTI for that offering during the 12 months preceding the event giving rise to the claim.
These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence where non-waivable, or death or personal injury to the extent caused by a non-excludable legal duty.
22. Indemnification for Participant Conduct and Professional Application
To the extent permitted by law, you agree to defend, indemnify, and hold harmless FTI and its owners, directors, officers, employees, instructors, contractors, hosts, and agents from third-party claims, liabilities, damages, judgments, and reasonable legal costs arising from:
Your unlawful, negligent, unauthorized, or unsafe application of information or protocols;
Your services, business representations, client or patient relationships, or breach of professional duty;
Your unauthorized teaching, reproduction, disclosure, certification, or use of FTI Marks;
Content or information you submit, publish, or share; or
Your material breach of these Terms or applicable law.
This section does not require indemnification for loss caused solely by an indemnified party’s own fraud, willful misconduct, or other liability that cannot lawfully be shifted.
23. Suspension and Termination
FTI may suspend or terminate enrollment, access, certification status, designation rights, or participation for material breach, non-payment, safety risk, infringement, misrepresentation, unlawful conduct, or violation of professional or certification standards.
Termination does not erase payment obligations or provisions intended to survive, including intellectual-property, confidentiality, liability, dispute, and enforcement provisions.
24. Governing Law and Dispute Resolution
24.1 Informal resolution
Before filing a legal proceeding, the parties will make a good-faith effort to resolve the dispute. A written notice describing the issue and requested resolution must be sent to info@fasciatraininginstitute.com. The receiving party will have 30 days to respond, unless urgent injunctive relief is reasonably required.
24.2 Canadian transactions
If the contracting entity is Simone Fortier Enterprises Inc., these Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. Subject to mandatory law, the parties submit to the courts located in Calgary, Alberta.
24.3 United States transactions
If the contracting entity is Fascia Brain Treatment & Training Inc., these Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-laws principles. Subject to mandatory law, the parties submit to the state and federal courts located in Wyoming.
24.4 Mandatory rights preserved
Nothing in this section deprives a consumer of a mandatory protection, forum, limitation period, or remedy that cannot lawfully be waived in the consumer’s place of residence or where the transaction occurred.
25. Changes to These Terms
FTI may update these Terms prospectively to reflect changes in law, operations, technology, offerings, or risk. The version accepted at the time of purchase governs that purchase unless:
The change is required by law;
The Participant expressly accepts the revised Terms; or
The Order-Specific Terms lawfully provide for an update affecting continuing access, membership, certification, or practitioner status.
Material changes will be communicated by reasonable means. Continued use after legally sufficient notice constitutes acceptance only where permitted by law.
26. General Contract Terms
26.1 Entire agreement
These Terms, the applicable Order-Specific Terms, and any document expressly incorporated by reference form the entire agreement concerning the transaction and replace prior discussions or representations on the same subject.
26.2 Severability and lawful modification
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent or modified only as necessary to make it enforceable. The remaining provisions remain in effect.
26.3 No waiver
A failure or delay in enforcing a right is not a waiver. A waiver must be in writing and applies only to the specific circumstance stated.
26.4 Assignment
You may not assign or transfer your agreement, access, certification, or rights without FTI’s prior written consent. FTI may assign the agreement as part of a reorganization, financing, sale, merger, or transfer of the applicable business or assets, subject to applicable law.
26.5 Electronic communications and signatures
Electronic acceptance, clickwrap acceptance, typed signatures, and electronic records have the same effect as originals to the extent permitted by law. You are responsible for retaining a copy of the Terms and transaction records.
26.6 Headings and interpretation
Headings are for convenience only. “Including” means “including without limitation.” A singular term includes the plural where context requires. These Terms will not be interpreted against a party solely because that party drafted them.
26.7 Notices
Notices to FTI must be sent to info@fasciatraininginstitute.com unless an Order-Specific Term provides another address. FTI may send notices to the email or mailing address associated with the Participant’s order or account.
27. Acceptance and Participant Acknowledgments
By purchasing, signing, checking the acceptance box, accessing materials, or participating, you confirm that:
You have read and understood these Terms and all applicable Order-Specific Terms;
You have had an opportunity to ask questions and obtain independent advice;
You accept responsibility for determining your lawful scope of practice and professional obligations;
You understand that participation, completion, certification, clinical application, trademark use, and authorization to teach are separate rights;
You understand that FTI does not authorize Participants to teach, train, supervise, certify, license, or enable another person to perform any FTI protocol or FTI Protected Content unless FTI gives prior express written authorization; and
You agree to be legally bound by these Terms.
No Guarantee of CEU Approval, Licensure Credit, or Insurance Coverage
Fascia Training Institute (“FTI”) provides educational programming only.
FTI does not guarantee and makes no representations or warranties regarding:
Approval, recognition, or acceptance of Continuing Education Units (CEUs), Continuing Competence Credits (CCCs), Professional Development Hours (PDHs), or equivalent credits by any professional association, regulatory college, licensing body, insurer, employer, or third-party organization
Acceptance of FTI programs toward initial licensure, license renewal, certification, recertification, or professional standing
Insurance coverage, reimbursement, indemnification, or recognition of services, techniques, or protocols discussed or learned through FTI programs
Approval, acceptance, and recognition of continuing education credits and insurance coverage are determined solely by the relevant professional association, regulatory authority, insurer, or governing body.
Participant Responsibility
Participants acknowledge and agree that:
It is their sole responsibility to confirm CEU eligibility, accreditation acceptance, and insurance recognition prior to enrollment
Participation in an FTI program does not create any obligation on the part of FTI to secure, apply for, or guarantee CEU approval or insurance coverage
FTI shall not be held liable for denial, limitation, or revocation of CE credits, licensure recognition, insurance coverage, or reimbursement related to participation in FTI programs
No Reliance
Enrollment in any Fascia Training Institute program is made without reliance on representations regarding CEU approval, licensure acceptance, or insurance coverage unless explicitly stated in writing by FTI.
Severability & Enforcement
This provision is severable and shall remain in full force and effect regardless of any other program descriptions, marketing language, or third-party communications.
